Getting a DUI in Wisconsin When You Are from Out-Of-State

 Posted on September 16, 2024 in DUI/OWI

Waukesha, WI DUI LawyerWith college football season underway, many sports fans flock to Wisconsin to enjoy a favorite American pastime. Since tailgate parties, backyard barbeques, and beer are popular parts of the general festivities, it is no wonder that many visitors from out-of-state end up with a DUI arrest in parallel with the football schedule.

Since Wisconsin has different traffic laws than other states, even neighboring states that are an easy drive away, it can be confusing and stressful for visitors to get pulled over and face the possibility of criminal charges. If this happens to you, speak with a knowledgeable Wisconsin DUI lawyer who understands how this type of case can affect you in your state of residence.

How Is an Out-of-State DUI in Wisconsin Penalized?

Wisconsin has different laws than other states. In general terms, it can be easier in some other states to avoid a DUI conviction, through plea bargaining, for example. In other states, you can sometimes get reduced charges, have your license suspended temporarily, be ordered to attend road safety classes, and then get your case dismissed and maintain a clean record.

In Wisconsin, these matters are handled a bit differently. Plea bargains are rare, so DUI charges are hardly ever reduced to lesser charges through negotiation. Often, in Wisconsin, your first DUI arrest can also be your first DUI conviction. However, the penalties for a first conviction in Wisconsin can be less severe than in other states:

  • Your license is suspended for six to nine months.

  • You are immediately eligible for an occupational license, which could allow you to drive to work and for other necessities.

  • You need to pay a fine of $150-$300, plus an OWI surcharge of several hundred dollars.

  • You need to attend a mandatory "alcohol assessment" that could result in required classes or treatment.

However, Wisconsin laws only apply in Wisconsin. The state cannot revoke your out-of-state license. It can only revoke your right to use your license in Wisconsin. On the other hand, all states report DUI convictions for out-of-state drivers to the driver’s state of residence. That means that once you go home from your trip to Wisconsin, your local authorities will begin proceedings against you. You would likely be subject to the same penalties you would face if you were convicted in your own state.
